The unsealed superseding indictment against Sam Bankman-Fried contains 12 felony counts

In a superseding indictment filed in the United States District Court for the Southern District of New York on February 22, U.S. Attorney Damian Williams argued that Bankman-Frieda’s conduct in the case involving FTX and Alameda warranted 12 counts. According to the indictment, these included:

  • Conspiracy to commit wire fraud on FTX customers
  • Wire fraud on FTX customers
  • Conspiracy to defraud FTX customers in connection with the purchase and sale of derivatives
  • Fraud on FTX customers in connection with the purchase and sale of derivatives
  • Conspiracy to commit securities fraud on investors in FTX
  • Securities fraud on investors in FTX
  • Conspiracy to defraud creditors of Alameda Research
  • Wire Fraud on Lenders to Alameda Research
  • Conspiracy to commit bank fraud
  • Conspiracy to operate an unlicensed money transmission business
  • Conspiracy to launder money
  • Conspiracy to make illegal political contributions and defraud the FEC

The original indictment against Bankman-Fried announced on December 13 included eight similar charges without breaking down the individual allegations regarding the former CEO’s alleged actions at both FTX and Alameda. At the time, prosecutors also alleged in their indictments a conspiracy to commit commodities fraud, which was seemingly included in a previous indictment related to the “purchase and sale of derivatives” at FTX.

Bankman-Fried’s criminal trial in federal court is scheduled to begin in October, while FTX’s bankruptcy case is pending in the U.S. Bankruptcy Court for the District of Delaware. Former Alameda Research CEO Caroline Ellison and FTX co-founder Gary Wang pleaded guilty to similar charges as SBF in the December plea agreement and may offer testimony in his case.
